Hazardous Activities and Industries List

The Ministry of the Environment has compiled a list of activities and industries commonly associated with contaminated land called the Hazardous Activities and Industries List (HAIL). The list identifies industries and activities that typically use or store hazardous substances and that could cause contamination if they escape into the environment. It also contains catch all provisions which capture any other land that has been subject to the intentional or accidental release of a hazardous substance or where a hazardous substance has migrated from adjacent land, in sufficient quantity that it could be a risk to human health or the environment. 4247

The HAIL is designed to assist local authorities in identifying potentially contaminated sites. These ‘potential’ sites require further investigation to determine whether the site is in fact contaminated. Regional councils maintain a contaminated site register, and territorial authorities may also maintain a register. This register is constantly updated by councils as they receive new information about a site and therefore councils take care to state that “it does not warrant its completeness or accuracy and disclaims any responsibility or liability in respect of the information”.
